Pricing: Prices are subject to change without notice. Taxes and shipping fees are additional unless explicitly stated.

Orders: We reserve the right to cancel or refuse any order for any reason, including suspected fraud or unauthorized activity.
4. Payment Terms

Accepted Payment Methods:
We accept the following payment methods:-
Bank Wire Transfer, Personal or Business Check, or Cash for larger orders.

VISA, Mastercard, Discover Credit Card, or PayPal for smaller orders.

Processing Fee:
A 3% processing fee will be applied to all credit card transactions exceeding $4,000. This fee will be added to the total amount at checkout or upon invoice. -
Payment Timing:
Payments must be made in full at the time of purchase unless otherwise agreed upon in writing. -
Late Payments:
Late payments for services may incur additional fees.
5. Shipping and Returns

Shipping:

All shipments are sent without shipping insurance by default. If the customer wishes to insure their shipment, they must notify EV West Inc. before shipping and agree to pay the additional cost of insurance.

EV West Inc. is not responsible for loss, theft, or damage to shipments that are not insured.

Shipping timelines provided are estimates and not guarantees. We are not liable for delays caused by carriers or customs.

Return Policy:
At EV West Inc., we are committed to providing high-quality parts and products. To maintain our standards, we enforce the following strict return policy:-
Eligibility for Returns:

All returned parts must be unused and free from any signs of installation, wear, or damage.

Returns must include the original factory packaging with all included components (e.g., instructions, accessories, labels).

Items must be in resellable condition, free from scratches, dents, or any modifications.

Return Process:

All returns require prior authorization. Contact us at sales@evwest.com to request a Return Merchandise Authorization (RMA) number.

Items will be inspected upon arrival to confirm compliance with the above conditions. Items that fail inspection may be refused or subject to a restocking fee of up to 25%.

Exceptions: EV West Inc. may make exceptions at its discretion after a thorough examination of returned items. Additional fees may apply.

Non-Returnable Items: Parts that have been installed, modified, or damaged, custom or special-order items, and items marked as "Final Sale" or "Non-Returnable" are not eligible for return.

Return Time Frame: Return requests must be initiated within 30 days of purchase.

Shipping Costs: Return shipping costs are the responsibility of the customer unless otherwise agreed upon. EV West Inc. is not responsible for lost or damaged return shipments.

6. Intellectual Property
All content on our website, including text, images, logos, and trademarks, is the property of EV West Inc. You may not reproduce, modify, or distribute this content without prior written permission.
7. Warranty and Liability

Battery Warranty:
Batteries sold by EV West Inc. carry a limited 1-year warranty covering defects or issues not caused by the customer. This warranty does not apply to batteries that are damaged due to improper installation, misuse, neglect, or unauthorized modifications. -
Other Parts:
All other parts sold by EV West Inc. are covered by their respective manufacturer warranties. Warranty claims for these items must be directed to the manufacturer according to their policies. EV West Inc. will assist in providing necessary documentation or guidance to facilitate the claim process but is not responsible for the manufacturer's warranty decisions. -
Warranty Limitations:
The warranties outlined above are the sole warranties provided. EV West Inc. disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, unless otherwise explicitly stated. -
Liability Disclaimer:
EV West Inc. is not liable for any incidental, indirect, or consequential damages arising from the use or misuse of its products or services, including but not limited to vehicle damage, personal injury, or financial loss. -
Vehicle Modifications:
Customers assume all risks associated with modifying vehicles, including compliance with local, state, or federal regulations.
8. Privacy Policy
Your personal information is protected as outlined in our Privacy Policy. By using our services, you agree to the collection and use of your data in accordance with this policy.
9. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
10. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the updated Terms.
11. Dispute Resolution

Informal Resolution:
If any dispute, claim, or controversy arises between the parties relating to these Terms or the use of our products or services, the parties agree to first attempt to resolve the issue through informal negotiations. Either party may initiate this process by sending a written notice to the other party, describing the dispute and proposing a resolution. -
Mediation:
If the dispute cannot be resolved informally within [15-30] days after the written notice, the parties agree to attempt to resolve the dispute through mediation. Mediation shall be conducted in good faith, and the parties will jointly select a neutral mediator. The costs of mediation will be shared equally unless otherwise agreed. If mediation does not resolve the dispute, the parties may proceed to arbitration as described below. -
Arbitration:
If the dispute is not resolved through informal negotiations or mediation, the parties agree to submit the dispute to binding arbitration. Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA). The arbitration will take place in San Diego County, CA and will be conducted by a single arbitrator. The decision of the arbitrator will be final and binding. Each party shall bear its own costs and expenses related to the arbitration, including attorney's fees. -
Exceptions:
Notwithstanding the foregoing, either party may seek injunctive relief or other equitable remedies in a court of competent jurisdiction.
